ACCEPTABLE USE POLICY

NIBIRU SOFTWARE INC.

This Acceptable Use Policy ("Policy") governs the use of the websites, software, customer portal, support services, forums, beta programs, downloads, APIs, and other online services (collectively, the "Services") provided by Nibiru Software Inc. ("Nibiru Software," "Company," "we," "our," or "us").

By accessing or using the Services, you agree to comply with this Policy. Failure to comply may result in suspension or termination of your access, in addition to any other remedies available under applicable law or contract.

  1. Purpose

This Policy is intended to:

  • Protect the integrity, security, and availability of the Services.
  • Promote a professional and respectful user community.
  • Safeguard the intellectual property and confidential information of Nibiru Software and its customers.
  • Prevent misuse of SQLDBD and related services.
  1. Authorized Use

You may use the Services only for lawful business purposes and in accordance with:

  • This Acceptable Use Policy;
  • The Nibiru Software Terms and Conditions;
  • The End User License Agreement (EULA);
  • The Privacy & Cookie Policy; and
  • Any applicable Order Form or Support Agreement.
  1. Prohibited Activities

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Attempt unauthorized access to any system, account, or network.
  • Interfere with or disrupt the operation of the Services.
  • Upload or distribute malware, ransomware, spyware, viruses, worms, or other malicious code.
  • Circumvent authentication, licensing, encryption, or security mechanisms.
  • Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks.
  • Attempt to exploit vulnerabilities in the Services.
  • Impersonate another individual or organization.
  • Use false or misleading registration information.
  • Harvest email addresses, customer information, or user data without authorization.
  • Use automated tools to scrape, copy, or systematically download website content without prior written permission.
  1. Software Usage

You shall not:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of SQLDBD except where expressly permitted by applicable law.
  • Circumvent software licensing or activation mechanisms.
  • Remove or alter copyright, trademark, or proprietary notices.
  • Use SQLDBD to create or assist in creating a competing software product.
  • Publish benchmark results or comparative testing of SQLDBD without the prior written consent of Nibiru Software.
  • Share license keys with unauthorized users.
  • Exceed purchased license limits.
  1. Community Standards

Users participating in forums, beta programs, support communities, or other collaboration services shall:

  • Communicate respectfully and professionally.
  • Refrain from harassment, discrimination, threats, or abusive conduct.
  • Avoid posting obscene, defamatory, or unlawful material.
  • Respect the privacy and confidentiality of other users.
  • Refrain from posting another person's personal information without authorization.

Nibiru Software reserves the right to remove content that violates these standards.

  1. Security Responsibilities

Users are responsible for:

  • Protecting usernames, passwords, and authentication credentials.
  • Promptly reporting suspected unauthorized access.
  • Maintaining appropriate security on systems using SQLDBD.
  • Installing security updates where applicable.
  • Maintaining current backups prior to performing maintenance operations.
  1. Confidential Information

Participants shall not disclose confidential information obtained through the Services, including:

  • Beta software.
  • Product roadmaps.
  • Pricing not publicly released.
  • Technical documentation marked confidential.
  • Security information.
  • Non-public features.
  • Customer information.
  1. Artificial Intelligence and Automated Data Collection

Except as expressly authorized in writing by Nibiru Software, you may not:

  • Use any content from the Services to train, fine-tune, or improve artificial intelligence, machine learning, or large language models.
  • Copy documentation, software, screenshots, or technical content for automated model training.
  • Perform automated scraping or large-scale extraction of content using bots, crawlers, or similar technologies.

Reasonable indexing by public search engines is permitted unless otherwise restricted.

  1. Intellectual Property and Patent-Pending Technology

All software, documentation, trademarks, logos, graphics, source code, object code, user interfaces, technical materials, and other content made available through the Services are and remain the exclusive property of Nibiru Software Inc. or its applicable licensors.

Certain technologies, methods, systems, and functionality incorporated into SQL Database Defragmenter (SQLDBD) are the subject of pending patent applications owned by or assigned to Nibiru Software Inc. ("Patent-Pending Technology").

The Patent-Pending Technology includes technology associated with SQLDBD's capabilities for identifying, analyzing, managing, and/or addressing Microsoft SQL Server MDF (Primary Data File) fragmentation, including functionality that may facilitate MDF and database index defragmentation.

No provision of this Policy, the Website, the Services, or your use of SQLDBD shall be construed as granting, by implication, estoppel, or otherwise, any license or right under any patent, patent application, copyright, trademark, trade secret, or other intellectual property right of Nibiru Software Inc. or its licensors, except for the limited rights expressly granted under the applicable Software License Agreement or EULA.

Users shall not:

  • Copy, reproduce, or distribute the Patent-Pending Technology except as expressly authorized.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the underlying methods, algorithms, processes, or source code associated with the Patent-Pending Technology, except to the extent expressly permitted by applicable law.
  • Attempt to circumvent, disable, or defeat technical protections associated with SQLDBD.
  • Use information obtained through SQLDBD to develop, implement, or assist in developing a competing product or technology.
  • Publish or disclose non-public technical information concerning the Patent-Pending Technology without prior written authorization from Nibiru Software.

The designation "Patent Pending" does not constitute a representation that any patent application will result in an issued patent or that any particular claim will be allowed. Patent rights, if granted, will be determined by the applicable patent authority.

All rights not expressly granted to the user are reserved by Nibiru Software Inc.

 

All software, documentation, trademarks, logos, graphics, source code, object code, and other materials available through the Services remain the exclusive property of Nibiru Software Inc. or its licensors.

Certain technologies incorporated into SQLDBD may be protected by issued patents and/or pending patent applications.

No rights are granted except as expressly provided in the applicable license agreement.

  1. Monitoring and Enforcement

Nibiru Software reserves the right, consistent with applicable law, to:

  • Investigate suspected violations of this Policy.
  • Remove content that violates this Policy.
  • Suspend or terminate user accounts.
  • Restrict access to the Services.
  • Report unlawful activity to appropriate authorities.
  • Take any other action reasonably necessary to protect the Services, customers, or Nibiru Software.
  1. Reporting Violations

Suspected violations of this Policy should be reported promptly to:

Nibiru Software will review reported violations and may investigate in accordance with applicable law and internal procedures.

  1. Changes to This Policy

Nibiru Software may update this Acceptable Use Policy from time to time.

Material revisions will be posted on the Website with an updated effective date.

Continued use of the Services after such changes constitutes acceptance of the revised Policy.
